Privacy policy

The protection of your personal data is extremely important for Winsol. Winsol will take the appropriate measures and guaranties in accordance with national and international regulation as processing controller of your data. The regulations applicable on this policy and the protection of your data are the following:

  • Regulation ( EU) 2016/679 of the  European parliament and the council of the 27th of April 2016 with regards to the protection of natural persons concerning the processing of personal data and on the free movement of such data, better known as “general data protection regulation” and of the withdrawal of the directive 95/46/EG (general regulation concerning data protection or GDPR/GCRD), Pb L. 4 may 2016, afl. 119 blz 1-88.

  • Belgian law of 30 July 2018 concerning the protection of natural persons with regards to the processing of personal data (WVG), BS 5 September 2018, 68616)

In this page an explanation will be given in clear and transparent wording on how we process your personal data for different purposes and how your personal data will be used within Winsol.

1. Who are we and what do we do?

We are Winsol and we are responsible for the processing of your personal data and the protection of this collected data. Our company does product development, production, sales, delivery and installation of goods and services such as, but not limited by; sun protection, exterior joinery, gates, blinds and pergolas.

2. What data do we collect and how do we collect this data?

Winsol mainly gathers personal (name, address, phone number,…..), financial (account number in case of payment) and electronic identification data (e-mail, IP-adress, cookies, times of connection) from among others its visitors, clients, suppliers, partners, contractors and subcontractors.

We collect personal data through:

  • Personal contact made in our showrooms/ in seminars/ conferences on the basis of  the personal data given to us.

  • On this website by the means of cookies (on the condition of being given permission by you to us, to learn more about this you can consult our cookie policy)

  • The contact form which you have filled in on our website,

3. What is the legal basis for the use of your personal data?

The current privacy regulations require that we tell you on the basis of which legal grounds we collect and retain personal data and for which purpose we process your personal data.

Briefly stated we collect and process your personal data for our standard business operations.
Specifically we use this data among other things for:

  • Research and development

  • Purchasing

  • Sales

  • The execution of agreements

  • Planning

  • Delivery and installation

  • After-sales and reparation

  • Reviews and customer satisfaction research

  • Manage an efficient customer management service (potential clients, current clients and regaining of lost clients)

  • Keeping correct accounting

  • Visits to our website

  • Marketing

  • Newsletters and emails

  • Personal sales advice

  • Humans resources

The legal grounds and/ or legal basis which Winsol relies on  (not limited by) the permission of the agreement, the execution of the agreement, the fulfilment of legal and statutory obligations and or legitimate interest.

4. Who has access to your data?

We try to process your user data as much as possible within the organisation of Winsol, however this is not always possible. Consequently your user data may be transferred occasionally to third parties. This will only be done when this is required for our services. The above mentioned third parties are (but not limited by): dealers, delivery partners, it-services, consultancy partners (for example data management platforms, media and advertisement agency’s and research bureaus to keep informing you as well as possible about the products in which you are interested) and parties which gather and process our reviews.

5. For how long will your data be kept?

We do not keep or process your personal data any longer than necessary. After the necessity to keep your data ends we will delete or anonymise your personal data for internal consulting and analysing to optimise our internal business processes.

We will respect specific time frames after which we will remove your personal data:

  • Inactive potential clients data will be removed after 2 years. After this period this user data will be removed or anonymised for internal reporting.

  • Inactive clients user data will be removed 10 years after terms of guarantee. After which this user data will only be used for internal business reporting. This does not exclude the fact that clients are expected to keep their bill of sale when they want to invoke their warranty.

  • Active clients user data will be kept for as long as the commercial cooperation continues and this cooperation is not cancelled by either one of the parties.

  • We are legally required to keep our fiscal and accounting documents for 7 years. This includes the data from your bill of sale, payment data and order details. After this 7 year term Winsol will destroy this data fully in accordance with GDPR and WVG regulations. We will however use the anonymised data

  • for internal business reporting.

  • When your products are being replaced or repaired we keep the data regarding your request for reparation/ replacement and contact info for 10 years. After this term we use this data only anonymously for internal business reporting.

  •  When you have given consent to receive our newsletter or when you have given consent to receive personalized messages this consent is kept for 5 years. When this consent is withdrawn the records of the withdrawal of this consent will be kept for 5 years.

  • Data uses to prevent fraud are kept for a longer timeframe. This is not fun, but it is necessary.

6. Wat are your rights and how can you exercise them?

As a data supplier U have different rights. Because of GDPR and WVG you have the right to:

  • look into your data: Every visitor of which we collect personal data has the right to demand access to this data and review it.

  • rectify this data: As a user of our services you have the right to improve, supplement or remove your user data.

  • be forgotten: as a user of our services you have the right to demand that your data is removed from our systems. This can however only be done to the extend in which the law and technology allows it. The right to be forgotten can only be exercised if this does not needlessly hinders the business interests of Winsol NV and any of her affiliated companies.

  • withdraw consent: Every user of our services whose personal data is being collected has the right to withdraw its consent. The consent to process personal data can even be withdrawn after this consent has already been given.

  • transfer data: as a user of our services you have the right to transfer the processing of your personal data to another responsible party.

  • limitation of processing: as a user of services you have the right to (temporarily) block the processing of your personal data.

  • resist decisions made by automatic processing. As a visitor and user you have the right to switch of automatic profiling.

Do you have a question or a request to exercise your rights and/or do you wish to file a complaint? You can simply write, email or file a registered letter to contact us. ( see the section “how to contact us” for our contact details) when you have come to the conclusion or when you think your personal data are being collected or processed in a way that is not GDPR compliant. In principal the exercise of these rights is for free. It is important to notify in your request which right(s) you wish to exercise with the extra notification how you are to be reached and additional information which confirms your identity. Without unnecessary delays our services will process, research and respond to your request.

7. How to contact us?

Gathered personal data will be collected on the secure servers of Winsol. As controller Winsol is responsible for GDPR compliance in all its branches.
